Pool: Yes the pool is a big expense, but each director has a fiduciary and legal
duty to maintain the common elements of your community until such time as that
element is no longer a part of the community. It has been determined by your legal
counsel that 67% of the River Landing owners must vote in favor of closing the pool.
That is 221 owners who must vote to close the pool. Based on not only the informal
poll that we did, but even the response to your own polls you had on your website,
at best it was split about 50/50 as to whether or not owners wanted the pool closed.
In addition, the number of owners that actually responded to all polls was less
than 100 so it's does not appear that there is sufficient support to close the pool.
I know and understand what you feel personally about the pool, but at this time
the Board has a legal and fiduciary duty to maintain it.
Website & Newsletter: Legally your board members are under no obligation to participate
in a website or newsletter. Normally I have been generating a newsletter the last
few years to mail with the semiannual statements which is always sent to the board
members prior to mailing for their approval. I do not expect that they contribute
to the newsletter, only that they approve it as its your community and I do not
want to make a statement or send anything out that is not approved by the majority
of Board members. Each director is a volunteer who already is doing more for the
community than 97% of the other owners in the community. Many of them even give
more time making sure the pool area is maintained in a clean and safe condition
between board meetings. Again, they are not paid to do this or do they expect to
get paid. They are simply doing it because they take pride in the River Landing
community. Past experience has shown, that without their contributions the problems
and vandalism would be much worse, meaning the cost of repairs would be much greater.
As you can see, each Board members is already doing their part. I have to be honest
here. It's unfair to expect them to contribute to your website or newsletter when
they are already doing more than the other 322 members of your community are doing.
It somewhat disturbs me to see that whenever one of your fellow board members does
respond to one of your e-mails it goes directly to your website with a negative
comment attached, such as the Board is not being transparent and you don't know
why they are not responding to your e-mail. They reason they do not comment is because
it most times goes straight to your website with a negative comment about the board
still not being transparent and you cannot see why they won't all contribute comments.
Your cannot have it both ways. You cannot expect your fellow board members to respond
to an e-mail only to see it posted on a website with a comment about how the board
is not being transparent and to scold the other board members who do not respond.
This is why you have board meetings - to discuss the issues and make decisions on
the workings of your community.
Transparency: You comment a lot about transparency. There are no secrets to the
actions the board members take. While Nevada Law requires they discuss delinquency
and violations in closed session with that information to remain confidential, all
other board actions are taken in an open session every month. The board members
follow an agenda, discuss all items on the agenda, then vote and move on. Owners
are properly notified of the meetings and are welcome to attend. They can make
comments on the agenda items or general comments about the community. As you have
seen for yourself, it's all out in the open. If an owner cannot make the meeting,
they can ask for a copy of the minutes or recording. In fact, they can view them
on your website. Other than mailing the minutes or sending a full recording to
each owner (who probably would either not read them or listen to the recording and
would be expensive), there is not much more that can be done to enlighten owners.
Your community is doing a good job making the information available and meeting
regularly to discuss the issues in your community that effect everyone. If owners
don't take the time to keep track of what your board members are doing, but coming
to meetings and/or requesting minutes, then that is on them. If there are owners
who do not think the board members are serving your community they have a chance
each year to run for the board themselves. As you know firsthand, you have now,
and have had in the past owners serve on the board who are attempting to make the
best decisions based on what is best for the community. While not everyone likes
the decisions that are made, they do have the option to run and serve themselves.
I really don't believe that you all can do any more than you are already doing.
I believe what I am trying to say is, please give your fellow board members a break
and stop hounding them to contribute to your website or newsletter. They are already
serving the community in their own way and no one has the right to expect more of
them then they are already giving. If you keep the pressure up for them to contribute,
they are going to get frustrated and quit and you may end up with no volunteers.
That would not be good for your community.
Thanks,
Scott Hedlind, CAM

Now Scott? This is the most you have ever written to us R/L Home Owners during
your entire 'tenure' as our HOA Manager! Congratulations!

And I was always well aware that any comments I made that were not very 'flattering'
to yourself and my fellow Board Members would maybe....just maybe......finally elicit
a response from you and our Board Members!
FINALLY!
Now? That we know you are more than capable? Could you please contribute to our
Message Board? REGULARLY!
It is TOTALLY FREE!
Saving us R/L Home Owners $150 in Postage every time you mail us something?
And since most R/L Home Owners are unable to attend our very lame HOA Meetings?
At least they all can:
"Have A Say In Their HOA"
24/7 - 365 Days a Year!

Now.........if we could also get our Board Members to also participate?
